The
following is a summary of the processes and requirements for public works
contracting with the Port of Anacortes, i.e., small works roster, advertising,
bidding, successful bidder award procedures, insurance requirements, and
prevailing wage law. The Port of Anacortes utilizes a Disadvantaged Business
Enterprise (DBE) Program for Department of Transportation (DOT) assisted
contracts. The policy statement is provided below. Click here to download the Small Works Application Form CONSULTANT SERVICES ROSTER:The Port of Anacortes maintains a consultant services roster, which includes various categories of professional disciplines. Whenever the Port has a need for professional services to be performed under the consultant roster, the specific discipline category is referred to and a selection is completed based upon an evaluation of the submittals as defined in the published criteria. The Port advertises and updates its consultant services roster annually in January, but will accept submittals to be placed on the roster any time. The Port may also on occasion publish project specific Request for Qualifications (RFQ) or Request for Proposals (RFP) for various services. Again, the selection is completed based upon an evaluation of the submittals as defined in the published criteria. Click here to download the RFQ Advertisement ADVERTISING: All major projects not solicited from the small works roster are advertised in the Skagit Valley Herald as well as the Seattle Daily Journal of Commerce. Advertisements indicate where a copy of the drawings and project manual may be picked up for bidding. Drawings and project manuals may also be viewed at the Port of Anacortes Projects Office, First and Commercial Avenue. Subcontractors may call the telephone number listed in the advertisement to get a list of general or prime contractors who have picked up the drawings and project manual. The project manual
describes the bidding and contracting requirements for the project. It
is essential that bidders and subcontractors familiarize themselves with
the bid documents for each contract in order to be responsive to the bidding
requirements.
All responsive bids must include the Bid Form completed in its entirety, Statement of Bidders Qualifications and Proposed Subcontractors, Deposit or Bid Bond Form with required 5% bid guaranty (either bid bond, cash, cashier's check, or certified check), and Non-Collusion Affidavit. SUCCESSFUL BIDDER: Within ten (10) days after the Notice of Contract Award is issued to the successful bidder, the Contract, Certificate of Insurance, Declaration of Option for Management of Statutory Retained Percentage, Contract Bond, and Statement of Intent to Pay Prevailing Wages must be properly executed and delivered to the Port. Upon subsequent contract approval by the Executive Director, a Notice to Proceed will be issued to the contractor for work to commence. INSURANCE REQUIREMENTS: Contractors shall procure and maintain, at their own cost and expense, comprehensive liability insurance in full force and effect at all times while operating on or about the Port's property. The coverage shall not be less than $1,000,000 per occurrence to include property damage, bodily injury or death. The Port shall be named as additional insured and shall be so indicated on the certificate of insurance provided to the Port. PREVAILING WAGE LAW: The Washington State Public Works Act, RCW Chapter 39.12, also known as the prevailing wage law, requires that employees of government contractors be paid prevailing wages for all public work. Agencies awarding public works contracts include state agencies, counties, municipalities, and all political subdivisions of the state. The Department of Labor & Industries administers the law. All public agencies, contractors performing public work, and construction workers on public works construction should be aware of their rights and legal responsibilities. Payroll reports for the contractor and each subcontractor must be submitted weekly for all federally funded projects. Other prevailing wage forms required include approved Statements of Intent to Pay Prevailing Wages (prior to monthly payments), an approved Affidavit of Wages Paid (prior to payment of retainage), and a prevailing wage statement with each request for pay. At the end of the project, the contractor shall request the Department of Labor & Industries to complete a Release, relieving the Port of liability for payment of the contractor's and subcontractor's industrial insurance premiums.
